MikeWeir.com's Win a Set of TaylorMade Clubs Contest
10 Oct 2001 - 10 Nov 20011. The MikeWeir.com’s Win a Set of TaylorMade Clubs Contest begins on October 10th, 2001 at 10:00:00a.m. and ends on November 10th, 2001 at 5:29:59 p.m. For purposes of this Contest, all times stated will be defined by Eastern Standard Time.
2. How to Enter: To enter, go to www.mikeweir.com during the Contest period and click on the Contest link. You must be registered with MikeWeir.com to enter. If you are a registered user, log in by entering your email and password (where indicated) in the To Log In area and click Go. Once in our registered user section, please verify that your information is correct and press Click Here to enter the Contest to continue. Please fill out our quick golf equipment survey on the following page and click Submit to enter into the Contest. A confirmation page will then indicate your online entry has been successfully entered in our pool of potential winners. If you are not a registered user, click on Sign Up and complete the information requested on the user/newsletter sign up form. The sign-up form requires you to enter your name, address (including postal/zip code), email and password of your choice. Once registered, you can log in as a registrant and complete the online entry form as instructed above. Entrants under the age of majority must have parent’s or legal guardian’s consent to the submitted entry. Each email address must be current, unique and valid. In addition, entries received online shall be deemed to be submitted by the holder of the email account.
3. No purchase necessary. You may enter only once. Additional entries will be disqualified.
4. The Prize: There will be two (2) prizes awarded. Each prize consists of one full set of TaylorMade clubs and bag. Each full set of clubs is comprised of three (3) 300Series metalwoods, one (1) set of 300Series steel irons ranging from the 3-iron to (PW) pitching wedge, and a putter. Prizes must be accepted as described and awarded, may not be substituted for cash value, assigned, transferred or sold. MikeWeir.com, TaylorMade Golf Company, Inc., TWIi, and all of their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns, from here on referred to as the Sponsor, reserves the right to substitute prizes with prizes of approximate equal value and reserves the right to terminate or withdraw this Contest at any time, without prior notice. Approximate retail value of each prize awarded is $3700 Canadian.
5. Selection process: On or about November 12th, two eligible entries will be selected by random draw by the governing bodies of the Sponsor. The odds of winning the prize will depend upon the total number of eligible entries received on or before the closing date. Winners will be notified by email and regular mail within approximately one (1) week of the drawing date. Prizes will be awarded within approximately six (6) weeks. In order to win, the entrants must correctly answer, unaided, a time limited mathematical question. Further arrangements will be made for delivery of prize after confirmation is received. If confirmation is not received within 7 days of the notification being sent, he/she will be deemed ineligible. If he/she cannot or does not comply with the Official Contest Rules or does not correctly answer the mathematical skill-testing question within the stated timeframe, the winner will be disqualified and an alternate winner may be selected at the discretion of the Sponsor. Winners (and winners’ parents or legal guardians both on behalf of themselves and minor, if winner is a minor) must complete, execute and return as requested a Declaration of Compliance, [in the United States – an Affidavit of Eligibility], and if requested and where lawful a Liability Release and a Publicity Release within seven (7) days of notification. Failure to return documents timely may result in disqualification.
6. Eligibility: The Contest is open to all residents living in Canada and the United States, excluding those who are residents of Quebec or employees of the Sponsors, members of their respective immediate families and those domiciled with said families. Entrants under the age of majority in his/her province, state or territory of residence are eligible to win the prize described herein, provided that the winning entrant's parent or legal guardian has given consent to the submitted online entry and accepts the prize on his/her behalf. Should the minor fail to abide by the Contest rules, the parent or legal guardian shall be held accountable. This Contest is void where prohibited by law and is subject to all applicable Federal, Provincial and Local laws and regulations.
7. The Sponsor reserves the right to prohibit an entrant from participating in the Contest or winning the prize, if, in the sole discretion of the Sponsor, it determines that the entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse or threaten or harass any other entrant or the Sponsor's representatives. Any person attempting to defraud or in any way tamper with this will be prosecuted to the full extent of the law. If, for any reason, the Contest is not capable of running as originally planned, such as tampering or infection by computer virus, the Sponsor at its sole discretion, reserves the right to conduct the drawing from all salvageable eligible entries received, if any.
8. The Sponsor reserves the right to disqualify any Entrant failing to comply with these Official Rules.
9. Disclaimer: All entries become the property of the Sponsor who assumes no responsibility taken for entries lost, misdirected or delayed, or for incomplete, lost, late, damaged, or misdirected e-mail, technical hardware or software failures of any kind, lost or unavailable network connection, or failed or delayed computer transmission which may limit a user’s ability to participate. This Contest is subject to these Official Rules that will be accessible from the Web Site during the Contest Period. By entering the Contest, entrants release all rights to bring any claim, action, or proceeding against Contest Entities and agree to waive any right to claim any ambiguity or error in the Official Rules of the Contest, or the Contest itself. Entrants agree to be bound by these Official Rules and by all decisions of the Sponsor, whose decisions are final and binding in all respects.
10. Each participant and winner (and winners parents and legal guardians both on behalf of themselves and minor, if winner is a minor) releases and agrees to hold harmless Sponsor, their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any kind of liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any Contest activity, or participation in this Contest.
11. To the extent permitted by applicable law, Sponsor is not responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of participation in the Contest, regardless of the cause of action under which such damages are sought.
12. Winners List: The full names of winners will be posted on or about November 21st, 2001 at www.mikeweir.com upon confirmation by the winners, or a list of winners may be obtained by sending a self-addressed, stamped envelope to: MikeWeir.com, 175 Bloor Street East, South Tower, Suite 400, Toronto, Ontario, Canada M4W 3R8 before December 12th, 2001.
13. All entrants acknowledge and agree that the information that they provide on any electronic entry created, may be kept and used, without further consent or compensation, for the Sponsor’s general marketing and advertising purposes.
14. All federal, provincial, state, and local laws and regulations are applicable. This Contest shall be governed by and interpreted in accordance with the laws of Canada. All taxes, and incidental expenses if any, are the sole responsibility of each winner. Return of a prize or prize notification as undeliverable will result in disqualification. If entrant is a minor, Sponsor will not provide any personally identifying information, regardless of its source, to any third party without the express written consent of entrant’s parent/legal guardian. Once submitted, entries become the sole property of Sponsor and will not be returned. In case of a dispute over the identity of an entrant who submitted a winning entry, the owner of the email account may be deemed the entrant, at Sponsor’s sole discretion. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Contest at the actual time of entry will be deemed to be the participant and must comply with the rules. Void in the province of Quebec, Canada, and where prohibited by law. If an American resident is selected as a winner, he/she must correctly answer a time based mathematical skill test administered by email/mail to be eligible for a prize.
